PUBLIC CONTRACT WITH THE RECRUITER

Effective 12/01/ 2023.

This Public contract between HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) and the Candidate, both referred to as “Parties” (the “Public Contract”) defines the terms and conditions under which HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) offers and the Candidate agrees to use the HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) Services, as described herein. This Public Contract is an integral part of and incorporates by reference the Terms of Use. The Public Contract is an addition to and, except where explicitly stated, does not supersede, replace, or limit other similar terms in the Terms of Use. Capitalized terms not defined herein are used in the meaning defined in the Terms of Use.

IN ORDER TO USE THE HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) SERVICES, THE CANDIDATE AGREES TO BE BOUND BY THESE CONTRACTUAL TERMS AND THE TERMS OF USE. IF THE CANDIDATE DOES NOT ACCEPT THESE CONTRACTUAL TERMS, THE CANDIDATE SHOULD NOT ACCESS OR USE ANY HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) SERVICES.

The Candidate is informed and agrees that the HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) Services are provided to the Recruiter on a paid basis. The Recruiter shall pay HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) the Reward on the terms described in the Public Contract with HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) at: https://happ.jobs/.

The Candidate undertakes to notify HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) of the remuneration of the Candidate under the Service Contract upon the HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) request if the Recruiter refuses to provide such information.

The Recruiter is obligated to pay HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) the Reward. HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) provides the HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) Services to the Candidate for free.

The Candidate is entitled to receive the Bonus from HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) if it recommends a person who meets the requirements and criteria of the Vacancy and with whom the Recruiter establishes cooperation in any form (hiring, execution of a service agreement, verbal agreement, etc.).

The Bonus shall be calculated upon the HIRING&APPLY LLC (aka Hiring and apply, happ.jobs)’s Reward and amounts to 1 % of such Reward or to 50 USD based on HIRING&APPLY LLC (aka Hiring and apply, happ.jobs)’s discretion.

You understand and agree that HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) is not a party to any Service Contract, is not involved in or responsible for any work performed or services provided by the Candidate, is not involved in or responsible for any payment made under the Service Contract, and has no control over any Candidate or the Recruiter. HIRING&APPLY LLC (aka Hiring and apply, happ.jobs) does not have any power or authority to, and does not determine any eligibility standards for any Service Contract, select or contract any Candidate to provide services to the Recruiter, determine or control any term or condition of the Service Contract or projects performed under it, or cause any Candidate or Recruiter to accept any Service Contract or perform any Candidate Services.

In order to improve the quality of the Services and to comply with legal requirements and respond to changing market conditions, this Public Contract may be amended by the Company unilaterally. The new version of the Public Contract comes into force from the moment of its publication at: https://happ.jobs/.

We will make reasonable efforts to inform you in advance of any material changes, but it is your responsibility to review this Public Contract from time to time and keep yourself updated. Your further use of the Services after any changes and (or) additions to the Public Contract are made shall constitute your consent to such changes and (or) additions.

IF THE CANDIDATE REFUSES TO ACCEPT CHANGES TO THE PUBLIC CONTRACT, THE CANDIDATE SHOULD NOT USE THE PLATFORM AND SERVICES. THE CANDIDATE UNDERTAKES TO SUBMIT ITS REQUEST TO DELETE ITS ACCOUNT AND TERMINATE ITS USE OF THE PLATFORM.
